Welcome to Imagenter AI, your gateway to cutting-edge AI video creation powered by Seedream-5, Wan 2.5, and additional state-of-the-art models. Your use of this platform constitutes acceptance of these Terms of Service. Should you disagree with any provisions herein, we kindly ask that you refrain from accessing our service.

Use of the Service

Our platform offers professional-grade AI video synthesis through Sora 2, Wan 2.5, and other sophisticated models, delivering authentic motion dynamics, audio integration, and multimodal processing. Your usage must comply with all relevant local, national, and international legal requirements.

User Accounts and Registration

1. Account Creation: To access certain features of the service, you need to create an account. You must provide accurate and complete information during the registration process.

2. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. User Responsibilities: You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

Content and Intellectual Property Rights

All technology provided through Imagenter AI, including but not limited to AI models (Sora 2, Wan 2.5), algorithms, processing infrastructure, and documentation, is protected under copyright law. The AI models are owned by their respective copyright holders and technology providers.

• You acknowledge that you do not own the underlying AI technology or intellectual property that makes up the Imagenter AI service, and you agree to respect the intellectual property rights of the model providers and any third parties.
• While you retain ownership of your input content and generated videos, the core AI models and technology remain the property of their respective owners.

Prohibited Activities

You agree not to engage in any of the following prohibited activities while using Imagenter AI:

• Generating sexually explicit, pornographic, or adult content of any kind, involving real or fictional individuals
• Unauthorized access to or reverse engineering of our proprietary AI model and algorithms
• Using the service to create harmful, misleading, or illegal content including deepfakes for malicious purposes
• Violating any person's privacy, publicity, or other rights when using their likeness
• Interfering with or disrupting the security or performance of the service
• Using the service for any illegal or unauthorized purpose
• Attempting to bypass any security features or usage limitations of the service

Privacy and Data Collection

Imagenter AI collects the following types of data:

• Account Information: Information you provide when creating an account
• Usage Details: Data related to your animation requests and service usage
• Device Information: Information about the device and GPU specifications you use to access our service
• Cookies: Data that helps us enhance your experience with our service
• Video Generation Content: Images, text prompts, and audio files you upload for processing. Generated results are retained for a maximum of 28 days, after which they are automatically and permanently deleted.

Service Usage and Limitations

• Our platform delivers professional AI video synthesis across various models, notably Sora 2 and Wan 2.5
• Output quality and generation time depend on your content, chosen model, and current system capacity
• Responsible usage of computational resources within reasonable boundaries is expected
• Platform accessibility may occasionally be affected by maintenance schedules and technical limitations
• Generated content is subject to a 28-day retention policy. Content older than 28 days will be permanently removed from our servers. Users are responsible for downloading any content they wish to keep.

Payments, Credits, and Billing

Imagenter AI operates on a pay-per-use, prepaid credits model. There is no mandatory subscription.

1. Credits: You purchase credits in advance, and each generation request consumes a number of credits based on the model and options you select. The credit cost is shown to you before you confirm each request. Credits are a digital good, have no cash value outside the platform, and are non-transferable.

2. Charging: Credits required for a generation are placed on a temporary hold when you submit a request. They are consumed when the generation succeeds and are automatically returned to your balance if the generation fails. You are not charged for failed generations.

3. Payment Processing: Payments are securely processed by Stripe. We do not store your payment card details. By providing payment information, you represent that you are authorized to use the payment method.

4. Pricing and Taxes: We may change our pricing and credit packages at any time; changes do not affect credits you have already purchased. You are responsible for any taxes associated with your purchase, except for taxes based on our net income.

5. Immediate Delivery: Credits are delivered to your account immediately upon successful payment. By purchasing and using credits, you expressly request immediate performance and acknowledge that, where a statutory right of withdrawal applies, you lose that right once the credits have been supplied and you begin using them.

6. Refunds: Refunds are governed by our separate Refund Policy. In summary, failed generations are never charged, and purchased credits are non-refundable once consumed.

Termination

We reserve the right to terminate or suspend your access to the service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the service, us, or third parties.

Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis. We make no warranties or representations about the accuracy, reliability, or availability of the service and disclaim all warranties to the fullest extent permitted by law.

Limitation of Liability

To the fullest extent permitted by law, Imagenter AI and its AI model providers shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use the service.

Indemnification

You agree to indemnify and hold harmless Imagenter AI, its AI model providers, affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the service or violation of these Terms.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes arising from these Terms or the service will be resolved through binding arbitration in accordance with applicable laws.

Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of the service after any changes signifies your acceptance of the new terms.
